LAND USE BOARD OF THE TOWNSHIP OF MOUNT HOLLY, BURLINGTON COUNTY
NOTICE OF PUBLIC HEARING
PLEASE TAKE NOTICE:
At its regular meeting on Monday, April 27, 2026, at 6:00 p.m., the Land Use Planning Board of the Township of Mount Holly (the “Board”) will conduct a public hearing at its regular monthly meeting on the potential settlement of the litigation titled Reginald Lewis Group, LLC v. Township of Mt. Holly Land Use Planning Board, which is pending in the Superior Court of New Jersey, Burlington County, under Docket # BUR-L-1429-25. A hearing will be conducted at the Mount Holly Firehouse Administration Building, 17 Pine Street, Mount Holly, New Jersey 08060, and is being undertaken pursuant to the requirements of N.J.S.A. 40:55D-28.
The property in question is designated as Block 65, Lot 20.01 on the Official Tax Map for Mount Holly Township, which is more commonly known as 433 Newcomb Drive. The property is located in the R-2 (Residential) District. The proposed settlement would amend a previously considered bulk variance Application submitted to the Land Use Planning Board on or about October 17, 2024 which Application was denied by the Board at a hearing conducted on February 24, 2025 as memorialized in Resolution #P-2025-11. The settlement would approve a revised design in an amended Application filed in April 2026, in which the Applicant seeks relief from Ord. § 149-96 (E), in order to be permitted to construct a single-family dwelling on lot measuring 4500 SF where the minimum lot size required for R-2 zone is 7200 SF. The dwelling as proposed complies with the setback requirements of the zone.
The settlement agreement permits either party to include such other reasonable terms and conditions for the relief requested so as to comply with the Municipal Land Use Law and to conform to the Township of Mount Holly’s Code, applicable zoning laws and Township’s Master Plan and Master Plan Reexamination Plan, any of which will be considered at the hearing on the Amended Application on April 27, 2026. At the time and place of the hearing at the regular meeting, the Applicant will make a presentation on an Amended Application filed with the Board. All interested persons will be given the opportunity to be heard.
A copy of the Amended Application with the terms for the settlement of the litigation are on file at the Township of Mount Holly Municipal Building, located at 23 Washington Street, Mount Holly, NJ 08060 in the Office of the Municipal Clerk and/or the Land Use Planning Board Secretary and may be inspected by all interested parties prior to said meeting during the Township’s regular office hours.
